District Sues Boosters

March 1, 2018

Last August, Ravenna (Mich.) Public Schools disbanded its athletics booster club. Now it has sued the club, seeking its $16,000 bank account, a popcorn popper, and other items from the concession stands.

According to mlive.com, in its lawsuit, the district alleges that the booster club misappropriated and wrongly claimed the money and items, thus causing a shortfall in the district's athletic department's budget. In response, the club claimed that its money must be distributed according to its bylaws.

The district argued that disbanding the club should result in the club's property returning to the district. The club argued that the district does not have the right to disband it, and that it can remain an independent non-profit corporation.

The dispute began in the spring of 2017, when the district claims that the booster club no longer followed its directions, resulting in the district sending a letter to the booster club announcing its disbandment on August 9, 2017. The club's bylaws say that in the event of its dissolution, the district will claim its property, but in September 2017, the club added a new section to its bylaws requiring a unanimous decision to dissolve the club.

On August 14, the club turned over its keys to the football stadium's concession stand, but also removed a popcorn popper, utensils, and shelving. The club claims that those items had been purchased with its money, while the school district claims them as its property.
