Class Action Granted

In 2016, St. Cloud State University removed six of its athletic programs. This included indoor and outdoor men’s track and field, men’s cross country, men’s and women’s tennis, and women’s Nordic skiing.

As a result, a report from Saint Cloud Times reports that the university has been sued for Title IX violations. The lawsuit was initiated by five women from the varsity tennis team; women from the Nordic ski team have since joined the plaintiffs.

A judge recently expanded the case by granting class-action status to the lawsuit. This enables the focus to go to all female student athletes, along with permitting a focus on institutional and personal harm.

“It’s about the harm to all female athletes,” Andrew James, a representative of the athletes, said.

However, a damages claim was dismissed—so female athletes will not receive financial damage. Instead, they will have the capability of asking for injunctive relief that could require the university to change facets of the athletic program in regard to monetary assistance and benefits.

A trial date hasn’t been set, but all parties are required to be ready by June. Finding others who may qualify under the class-action lawsuit is the next move for the case.
